1General principles

These General Terms and Conditions govern the sale of admission tickets or other access authorisations for the RVBANG event and participation in this event.

2Conclusion of contract and payment

Plans of the venue of any kind are for orientation purposes only and do not constitute a true-to-scale representation of the venue. The customer bears the risk for the correct entry or provision of information in the ordering process, in particular with regard to the selection of the event, venue, date and seat. The purchase of tickets, products and other services is only permitted for persons aged at least 18 with unrestricted legal capacity or with the consent of their legal representative. The contract between RVBANG and the customer is concluded upon acceptance of a purchase offer (advance sale at advance sales outlets, online purchase or purchase at the box office). When purchasing tickets or other products, service and shipping charges as well as – to the extent legally permissible – fees for the use of selected payment methods are charged (“fees”). These additional fees are communicated to the customer during the ordering process. Ticket prices and fees include statutory VAT. The purchase price and the fees are due for immediate payment upon conclusion of the contract. The tickets or other products are delivered by the shipping method chosen by the customer after conclusion of the contract, i.e. after full payment of the ticket price and the fees, within the stated delivery period (online purchase).

3Right of withdrawal

Pursuant to § 312g(2) no. 9 BGB (German Civil Code), there is no right of withdrawal, as this is a ticket sale in connection with leisure activities.

4Tickets

By purchasing a ticket, the customer acquires the right to attend the RVBANG event. After receipt, tickets must be kept in a safe place and protected from harmful influences such as direct sunlight, heat or moisture, as illegibility of the information on the ticket that is relevant for admission control may render the ticket invalid and thus result in the loss of the right of admission. RVBANG is not obliged to carry out identity checks at admission and is also released from its obligation to perform towards the customer if it grants another person access to the event upon presentation of the ticket. Tickets are sold exclusively for private, non-commercial use. Trade and commercial ticket sales are reserved solely to RVBANG and to advance sales outlets authorised by RVBANG. In particular, it is not permitted to publicly offer tickets for sale or sell them in an auction or on the internet. A private transfer of a ticket for non-commercial reasons (illness or other inability of the customer to attend) is permitted. In this case, the customer can only transfer the rights and obligations under the contract to a third party by the third party taking the customer's place and assuming all rights and obligations. However, the customer is obliged to expressly inform the third party of the validity and content of these terms and conditions, and the third party must agree to their inclusion. It is the customer's own responsibility to check, by means of the information published by RVBANG, that the event is taking place unchanged, in particular on the day of the event, and in particular to use RVBANG's website for this purpose.

5Warranty and damages

The customer is entitled to the statutory warranty rights. RVBANG may change the programme if special incidents or events beyond the control of RVBANG as organiser make this necessary. In this case, there is no entitlement to an exchange of the tickets or a reimbursement of the ticket price, provided the change is insignificant. In the event of cancellation or postponement of events for which RVBANG is responsible, as well as in the event of other incidents giving rise to claims against RVBANG, the claim is limited to reimbursement of the face value of the ticket. If the event consists of several parts or is spread over several days and the cancellation or postponement only affects part of the event, there is, as a rule, an entitlement to reimbursement only in respect of the cancelled or postponed part of the event; in this case, the tickets otherwise remain valid. Travel and accommodation costs will not be reimbursed. RVBANG is liable within the scope of the statutory provisions for injury to life, body or health and for damage giving rise to liability of the manufacturer under § 1 ProdHaftG (German Product Liability Act). For any other damage, RVBANG is liable exclusively in accordance with the following provisions: RVBANG is liable in accordance with the statutory provisions for damage caused by fraudulent conduct, intent or gross negligence. In the case of simple negligence, RVBANG's liability is limited to the amount of the foreseeable damage typical for the contract.

6Rules for visiting RVBANG

The site is not public and RVBANG holds the domestic authority (Hausrecht). Access to and presence on the site is only permitted with a valid admission ticket or other access authorisation. The admission ticket must be carried until leaving the site and shown to RVBANG on request. Children and young people who have not yet reached the age of 14 must be accompanied by a person with parental responsibility or a suitable supervising person. Otherwise, the provisions of the German Youth Protection Act (Jugendschutzgesetz) apply. For safety reasons, a ban on bringing bags and backpacks as well as an obligation to hand in bags, backpacks and cloakroom items may be ordered. The customer must expect bag and body searches to be carried out and containers, coats, jackets and capes carried to be checked for their contents. RVBANG accepts no liability for valuables, money or keys in bags, backpacks or cloakroom items that have been handed in. Admission will be refused to persons who

• cannot present a valid access authorisation
• are visibly under the heavy influence of alcohol or drugs
• visibly intend to disrupt the event
• do not consent to inspection measures
• violate these terms and conditions
• carry prohibited items or
• have been banned from the premises.

If they have already been admitted, these persons may be expelled from the site and must leave the site. A refund of admission fees is excluded in these cases. For safety reasons, the closure and evacuation as well as the termination of the event may be ordered. In this case, the instructions of RVBANG must be followed. In this case, a refund of admission fees must be claimed within 14 days. If the claim is made late, a refund is excluded. Without the express permission of RVBANG, the following is prohibited

• Smoking – including e-cigarettes – in all enclosed spaces
• Leaving luggage or other items brought along unattended; in the case of grossly negligent conduct, RVBANG reserves the right to charge the costs of the necessary security measures
• Harassing people
• Blocking emergency and escape routes
• Commercial activities of any kind (including photo, film, video, sound and television recordings)
• Distributing and putting up printed matter, advertising material, posters, stickers, etc.
• Use of drones
• Carrying firearms, slashing, stabbing and thrusting weapons of any kind as well as other objects which by their nature are suitable for injuring persons or damaging property
• Items made of fragile or splintering material
• Substances that are harmful to health, corrosive, highly flammable or dyeing
• Gas cylinders, gas spray cans and pressurised containers
• Pyrotechnics, fireworks, rockets, smoke powder, flares and other pyrotechnic articles as well as explosives
• Flags, banners, banner poles and propaganda material whose content is racist, xenophobic or radical or directed against the free democratic basic order
• Animals.

The facilities on the site must be treated gently and with care. Waste, packaging materials and empty containers must be disposed of in the containers provided. Escape and emergency routes as well as safety equipment must be kept clear at all times.

7Changes to the programme

Should there be significant changes to the programme schedule, such as the cancellation of individual acts – including headliners – visitors shall have no claims against the organiser. This is subject to the condition that the adjustments remain within a reasonable scope and that the overall character of the RVBANG Festival is preserved. Postponements or relocations of performances must be accepted. The organiser will provide information about changes as quickly as possible at www.rvbang.de and via the official social media channels.

8Right to one's own image

Please note that photo, film and video recordings are regularly made on the event site for the purposes of reporting, documentation or advertising. By entering the event site, the customer declares their consent to such photographs and recordings in which they are depicted and to their publication, unless they have made a different declaration to the photographer.

9Final provisions

The invalidity of individual provisions shall not affect the validity of the remaining provisions. The law of the Federal Republic of Germany applies exclusively, excluding German private international law (IPR) and the UN Convention on Contracts for the International Sale of Goods (CISG). The sole place of performance for deliveries, services and payments is the registered office of RVBANG as organiser. If the customer is a trader (Unternehmer), the registered office of RVBANG is the exclusive place of jurisdiction for all disputes arising directly or indirectly from the contractual relationship. RVBANG is neither obliged nor willing to participate in the dispute resolution procedure.
